Why Estate Planning?
You may be one of many Americans who has spent decades building your wealth and accumulating assets. But do you know where all that wealth in your estate will go after your death? If the answer is no, you are not alone.
Studies show that more than two-thirds of American adults do not have an estate plan in place. This is problematic for one simple reason: If there is no estate plan in place, you will have no control over who receives your assets after your death. Instead, your estate must go through probate.
Probate
Probate is a court-supervised process which determines how an estate is distributed after one’s death.
Probate court is notorious for being problematic. Probating an estate can take up to 18 months. All probate hearings are available to the public. And probate court is not cheap, as the attorney’s fees awarded by the courts for probating an estate can be very generous.
But here’s the worst part: probate hearings are known for being emotionally draining. It is very common for children to fight over how their parent’s estate will be divided up. Estates involved in probate are also rife with mismanagement.
If your estate winds up in probate court, you have no control over what happens next. So how do you take back control? You do so by forming a revocable living trust.
